This Public Agreement, posted on the website https://gepur.com/en, constitutes an official offer from the Online Store to conclude a public purchase and sale agreement. The Agreement regulates the remote sale of Goods via the Internet, namely the voluntary selection of Goods in the Online Store, independent placement of orders, payment, and delivery of Goods under the terms of this Agreement.

In accordance with Articles 633, 641, and 642 of the Civil Code of Ukraine, this Agreement is general and open to all natural persons who temporarily or permanently reside in Ukraine, possess full legal capacity and ability to act, and understand the legal significance of their actions and their legal consequences. This Agreement is equivalent to a written contract concluded between Buyers and the Online Store. The Buyer may not propose alternative terms for concluding the Agreement with the Online Store and agrees to the conditions regarding the procedures for placing orders, payment, and delivery of Goods.

1. Terms
1.1Online Store - The website https://gepur.com/en is the official distributor of “Gepur” brand Goods. The website displays Goods and provides order placement services. The Online Store is not the manufacturer of the Goods; however, it collaborates with Suppliers who produce Goods under the brand owned by the Online Store. The Online Store and the content on the site are owned by Sole Proprietor Oleh Ihorovych Sadovskyi, Company Code: 3191720115, registered at 65062, Odesa, Kamanina Street, 13.
1.2Content - The intellectual property of the Online Store, including:
1.2.1Software code, comprising all scripts, algorithms, and other technical components that ensure the functionality and interaction of the Online Store with Users.
1.2.2Design, webpage designs including color schemes, fonts, layouts, and other elements that determine the interface’s appearance.
1.2.3Product descriptions, information for each Good, including its specifications, sizes, materials, country of manufacture, and other important details.
1.2.4Articles such as useful articles and blogs about fashion, style, trends, advice on clothing combinations, and other interesting materials.
1.2.5Photographic and video materials showcasing images and videos of the Goods that demonstrate their appearance, functions, and methods of use.
1.3Personal Account - A service provided by the Online Store that allows an authorized User to review his/her order history, add Goods to a wish list, review the shopping cart, edit personal data, and use bonuses and the loyalty system.
1.4Personal Data - Information that identifies the User and is necessary for ordering Goods.
1.5Supplier - A natural person-entrepreneur or legal entity that supplies Goods produced under the brand owned by the Online Store, in accordance with the agreement between such a person and the Online Store.
1.6Goods - Branded clothing, accessories, and lingerie listed in the Online Store, which the Buyer can purchase.
1.7Cookie - Small text files that store information about previous actions of the User in the Online Store (for example: the date and time of visit, the language used, preferences).
2. Procedure for Concluding the Agreement
2.1Registration on the Online Store and/or placing an order without registration confirms that the User accepts the terms of the Agreement and provides complete and unconditional consent (hereinafter “Acceptance”) without the need for a signed paper version of the Agreement by the Parties. If the Buyer disagrees with the terms of the Agreement, he/she cannot place an order for Goods and/or register on the Online Store.
2.2By concluding the Agreement, the Buyer automatically confirms that he/she has read and agreed to all provisions and conditions. The Agreement comes into force upon Acceptance and remains valid until both Parties fulfill their obligations under it. The place of conclusion of this Agreement is the city of Kyiv.
3. Registration and Authorization
3.1The Online Store provides the User with the preliminary opportunity to select and order Goods without registering; however, based on the data provided when placing an order, the Online Store registers the User. To obtain further access to additional services of the Online Store, including the loyalty program, personal discounts, and the Personal Account, the User must register on the Online Store.
3.2For registration on the Online Store, the User must provide the following Personal Data: surname and first name, email address, and contact phone number. By registering on the Online Store, the Buyer automatically subscribes to receive informational messages via email, Viber messenger, or SMS to the mobile phone.
3.3The User can log in using the phone number and the access code received via Viber and/or SMS, by entering an email and password into the authorization form, or via a Google, Apple, or Facebook account.
3.4In case of losing the password to the Personal Account, the Buyer may send a request for its recovery. After sending the request, the Buyer receives a link for password recovery at the email provided during registration.
4. User’s Personal Account
4.1After registration and authorization, the Personal Account gives the User access to view and change his/her Personal Data, including contact information and other Personal Data, view the bonus account, and receive order and payment confirmations.
4.2Personal Data: The User has access to the contact information collected and stored during the registration process on the Online Store or during offline registration of the Buyer in the database when purchasing Goods. The User may edit his/her contact information and change his/her password if registration was done using an email and/or phone number.
4.3Bonus account: The User may use funds from previous orders credited to the bonus account for placing orders on the Online Store. In the cart section, the User can choose the “Balance” payment method. For any questions or issues with topping up or withdrawing funds, contact the Online Store support service.
4.4Orders: The User can view all placed orders in the Online Store by selecting the orders section in the Personal Account, where order details will be available. The User can also delete or archive order information.
4.5Payment Notifications: After placing an order and paying for Goods, the User may notify about the payment in the Personal Account and/or receive a confirmation of payment via a call from the manager. The User will also receive a notification with a fiscal receipt via SMS and/or email.
5. Online Store Services
5.1Product Catalog: The catalog is divided into categories according to the types of Goods, collection names, product descriptions, promotions, and/or discounts. The names of product categories, collections, and Content may be changed by the Online Store. In the catalog, you can view all collections or filter Goods by different collections and categories.
5.2Size Selection: To facilitate the choice of Goods in the Online Store, the User can use a size chart for selecting sizes for women’s clothing, lingerie, and footwear. The User may also seek advice from a manager on how to measure their dimensions accurately.
5.3Wish List: The User can select Goods, including sizes they like, add them to a wish list, view the wish list, and move items from the wish list to the Shopping Cart.
5.4Search: To search for a specific Good in the Online Store, the User can enter the name, category, or SKU of the desired Good.
5.5Shopping Cart: To place an order, the User needs to add the selected Good to the cart, where he/she can check its appearance, size, SKU, price, and quantity; select one or several Goods for purchase; choose a payment and delivery method; and apply a discount, certificate, promo code, or bonuses. In the cart, there is an option to select premium packaging for the Good at an additional charge, as determined in the “Payment” and/or “Cart” sections. This service is available only with online payment by the methods specified in the Payment section or by bank transfer.
5.6Placing an Order: The User may place an order for any available Good in any quantity offered by the Online Store. If a Good is unavailable, the manager will notify the User via email, Viber, and/or SMS or phone call. An order is considered properly placed if the User fills in all the form fields that allow his/her identification and delivery of the Good.
5.7Currency and Language: Users can configure the language in which the Online Store’s Content is displayed. The Content providing descriptions and details about the Goods may differ in various languages, and the currency used to display the price of the Goods may also be changed. Note that Buyers can pay in the currencies indicated on the Online Store’s pages, but conversion during processing will be carried out in Ukraine’s national currency — the Hryvnia — at the rate determined by the processing bank. The price displayed in a foreign currency is provided for marketing purposes; all transactions will be processed in the national currency after conversion.
6. Payment for Goods
6.1Payment Methods: The Buyer can pay for an order using the Bonus account in the Personal Account, Visa/MasterCard, and/or Apple Pay/Google Pay. In the case of payment by bank transfer, the shipment of the Good will be made after confirmation of payment in the Personal Account or through the Online Store’s manager. For payments made through the “LiqPay” system, payment confirmation is not provided. The Buyer may also transfer funds to the bank account using the provided details. After the funds are transferred according to these details, the Buyer receives confirmation via email.
6.2If paying for the Good using non-cash methods (Visa or MasterCard), the Buyer pays for the Good on the Application page. When using the “LiqPay” payment system, the payment is made on the secure page of the payment system, protected by security certificates. Buyers pay only the price of the Good; no additional online payment commission is charged. Non-cash payments are made under the conditions provided by the “LiqPay” system. The Buyer may also use the “installment payment” service by dividing the payment into 3 parts; the conditions for installment payments are provided by the Online Store upon request.
6.3To avoid additional commission fees when paying for the Goods, we recommend using non-cash payments directly through the Online Store.
6.4Receipts and payment confirmations for the Good are sent to Buyers via Viber and/or SMS immediately after the order is paid.
7. Cost of Goods
7.1The price of a Good is the price listed in the Online Store. This price is the price of the Good under the Agreement, except in cases of obvious errors. Although we make every effort to keep all prices listed in the Online Store up to date, there is a possibility of errors. If we discover an error in the price of any Good ordered by the Buyer, we will immediately notify you and offer the choice of either confirming the order with the correct price for the Good or canceling the order.
7.2Prices of Goods in the Online Store may be changed at any time. However, except as provided above, any change in price does not affect an order for which confirmation has already been sent.
8. Delivery of Goods
8.1Delivery: We may deliver Goods by various methods: via "Nova Poshta" or "UkrPoshta," courier delivery by “Nova Poshta,” “UkrPoshta,” “Uklon,” EMS delivery, or city courier delivery in Odesa. The Buyer may choose the delivery method when placing an order. The list of delivery methods and services is not exhaustive and may be changed. Details regarding delivery methods and conditions will be posted on the website.
8.2Dispatch and Delivery Time: Usually, Goods are shipped after 18:00, and delivery times may range from 1 (one) to 10 (ten) business days, depending on the availability of Goods in the Online Store’s warehouse as well as in the retail network. In some cases, delivery delays are possible — for example, during public and/or calendar holidays and/or due to insufficient stock. If the Goods are unavailable, the manager will inform the Buyer and agree on revised delivery timelines, or arrange an exchange for another Good and/or process a refund for the amount paid for the Good in accordance with the payment refund procedure. The Online Store may also deliver Goods internationally; international delivery times depend on the recipient’s country, border conditions, customs procedures, and regulations, and generally range from 10 (ten) to 90 (ninety) days. The Buyer assumes responsibility for all customs procedures for the Good, including the payment of customs duties if the value of the Good exceeds the tariff-free threshold.
8.3Shipment Notification: After your order is dispatched, we will send the Buyer the consignment note number (TTN) via email, SMS, and/or through the Viber messenger. Delivery of the Good is considered confirmed when the Buyer receives it at the specified address and/or pick-up point.
8.4Delivery Area: The Online Store delivers Goods throughout Ukraine; however, due to force majeure circumstances in Ukraine, the delivery area is limited in the following regions: Crimea, Luhansk and Donetsk regions, as well as some cities, villages, and settlements in the Kharkiv, Kherson, Zaporizhzhia, and Sumy regions.
8.5Inspection upon Receipt: Please check upon receipt of the Goods whether they are undamaged and meet the stated quality characteristics. If you discover any damage to the packaging and/or the Goods themselves, please request that the courier or the person providing the Goods at the pick-up point complete a damage report for the Good.
8.6Multiple Shipments: Goods may be sent to the Buyer in several separate shipments depending on various factors, such as the quantity of Goods, their sizes, compatibility groups, different Suppliers, storage locations, available methods of payment and delivery, the overall value of the order, etc. The quantity and approximate cost of each shipment, as well as the delivery cost for each, will be displayed in the Cart. The Online Store is not responsible for the final delivery cost; delivery tariffs are provided by the delivery service provider.
9. Returns and Exchanges of Goods
9.1The Online Store regulates the procedure for returning and exchanging Goods in accordance with the Law of Ukraine "On Protection of Consumer Rights". Within 14 (fourteen) calendar days from the receipt of the Good, the Buyer has the right to return and/or exchange it if the Good does not meet their expectations in terms of form, dimensions, style, color, size, or for any other reasons that make it unsuitable for its intended use, pursuant to Article 9 of the Law "On Protection of Consumer Rights".
9.2Exchange and/or return of a Good of acceptable quality or a Good that is unsuitable for any other reason is carried out under the following conditions:
9.2.1The Good has not been used and shows no signs of wear;
9.2.2Its consumer properties and commercial appearance are preserved;
9.2.3Tags and labels are attached, and the original, undamaged packaging is intact;
9.2.4The Buyer bears the delivery cost for the return or exchange of the Good.
9.3In the event that the Buyer receives a Good that does not match the order in color or SKU, or a Good of unsatisfactory quality due to a manufacturing defect and/or significant shortcomings rendering it unusable, the Buyer is entitled to exchange and/or return such Good within the period specified by Ukrainian legislation. In this case, the Online Store bears the delivery cost for the return of the Good.
9.4If the Buyer, on their own initiative, orders damaged or poor-quality Goods for which the Online Store offers a discount or markdown, such Goods are not subject to exchange and/or return. The Buyer agrees to these terms and waives any future claim for the return and/or exchange of the Good.
9.5Ukrainian legislation specifies a list of Goods that cannot be returned. Buyers are not entitled to return Goods that have been used, tailored to a specific User, or are non-returnable for hygiene reasons, namely lingerie, bodysuits, pajamas, corsets, swimsuits, as well as opened or tried-on tights and socks.
10. Processing of Returns and Exchanges of Goods
10.1To process a return of a Good, the Buyer must complete a return form provided with the order. After that, the Good must be sent to the address specified on the return form. If the Buyer rejects a Good upon delivery at the delivery point (in cases of cash-on-delivery), the Buyer must complete the return form on site, send the Good to the address specified on the form, and notify the delivery service that the Good is being refused.
10.2After receiving the returned Good, we will inspect it for any signs of damage or use. If no such signs are found, we will process a full or partial refund to the Buyer’s bank account within 7 (seven) days from the date of receiving the returned Good. The amount will be refunded to the bank account from which the payment was made (in cases where the payment was processed through a payments system) or to the Buyer’s account upon submission of IBAN, tax identification number, surname, first name, and patronymic. If you do not have access to the card used for the original payment (for example, if it is blocked), we will send the funds back to the original card and provide you with the RRN code to contact your bank and transfer the funds to a current card. If the Buyer returns a Good that was ordered by cash-on-delivery, the funds may be used for future orders and/or the Buyer may request a direct transfer. Refund conditions will be determined in agreement with the Online Store’s manager.
10.3If, upon inspecting a returned Good of acceptable quality, signs of use, washing, damage, or odor (such as from sweat, perfume, or other sources), cosmetics residues, or stains are found, the Good will not be eligible for a refund and will be sent back to the Buyer at the delivery address specified in the order, at the Buyer’s expense.
10.4To process an exchange, the Buyer must complete an exchange form provided with the order, specifying the SKU and name of the Good to be exchanged, and send the original Good to the address specified on the form. The Buyer must also contact the Online Store’s manager to reserve the Good for exchange. If there is a price difference, the Buyer must follow the instructions provided by the manager. The exchange will be processed once the Online Store receives the returned Good.
10.5If the Buyer decides to return or exchange Goods that were purchased with discounts or promotions based on the total number of items in the order, the return or exchange must apply to all items in the order. The Online Store cannot exchange a single Good in place of the whole order.
11. Removal of Goods. Refusal to Process an Order
11.1We reserve the right to remove any Good from the Online Store’s catalog and/or change any material specified in the description of the Goods. While we make every effort to match our services and Goods to their stated quality and description, in the event of removal or replacement of materials, the Online Store shall not be liable to Buyers or any third party for such actions.
11.2Despite our best efforts to process orders, circumstances may arise that force us to refuse the processing of an order even after a confirmation has been sent to the Buyer. We reserve the right to do so and shall not be liable for any consequences incurred by Buyers or any third parties due to our refusal to process an order after sending the order confirmation.
12. Loyalty Program and Bonuses
12.1Gepur Sisters Club. The Online Store has a loyalty system for Buyers. Depending on their loyalty level, Buyers may enjoy benefits and opportunities such as: gifts from Gepur friends, discounts and exclusive sales, special news, birthday presents, personal invitations to events, unique surprises and secret offers, and even assistance with organizing dates or photo sessions.
12.1.1Young Sister. The first loyalty level, which a Buyer reaches after making their first purchase.
12.1.2Sister. The second loyalty level, which a Buyer reaches after purchasing Goods totaling 30,000 hryvnias within the subsequent 6 months.
12.1.3First Sister. The third loyalty level, which is offered on a personalized basis by the Online Store.
12.2Bonuses. Within 14 (fourteen) days after the purchase of a Good, from 3% of its cost is credited to the Buyer’s bonus account at the rate of 1 bonus = 1 hryvnia. The bonuses available in the User’s bonus account are valid for 6 (six) months from the moment of credit and can be used to pay for up to 30% of the cost of the next Good. The User may use the bonuses to order any Good. If a Good purchased with bonuses is returned and/or exchanged, the Online Store will return the bonus amount to the User’s bonus account in full, or deduct the difference in the case of an exchange.
12.3Additional Promotions. The Online Store provides additional promotions depending on the season or other events, for example: promotions and discounts on the User’s birthday, Wheel of Inspiration, collection sales, and discounts.
12.4The list of additional promotions and loyalty benefits is not exhaustive and may be supplemented, amended, or removed by the Online Store.
13. Suppliers
13.1The Online Store collaborates with various Suppliers who provide Goods under the Online Store’s own brand. The Goods produced by these Suppliers are listed and marketed through the Online Store’s platform under its own name.
13.2The Online Store safeguards the confidentiality and terms of agreements concluded with the Suppliers; therefore, it does not provide Buyers with a list of Suppliers or details about them.
13.3To facilitate payments for the Goods, the Online Store and the payment system may provide you with the banking details of the Suppliers. This procedure streamlines payments and helps process orders efficiently.
14. Rights and Obligations of Buyers
14.1The Buyer has the right to order Goods without registration, to register on the Online Store and access the Personal Account and services, to order and receive Goods, to refuse a purchase and return Goods, to opt out of receiving newsletters from the Online Store, to use bonuses, discounts, and the loyalty program, to review the conditions for processing Personal Data and to restrict their usage in accordance with the Agreement, to leave reviews, and to choose the method of Goods delivery.
14.2The Buyer is obliged to comply with the terms of the Agreement, to pay for and accept the ordered Good in accordance with the terms provided in the Agreement, to read the instructions and follow the operating conditions of the Good before using it, to use the Online Store’s Content only in a permitted manner, and to safeguard access to the Personal Account from unauthorized access by third parties.
15. Rights and Obligations of the Online Store
15.1The Online Store has the right to publish, modify, or delete Goods and their prices; to provide, change, or remove promotions, discounts, and the loyalty program; to receive payment for Goods; to refuse to sell Goods to the Buyer in case of a violation by the Buyer of the terms specified in the Agreement; to publish Supplier Goods on the Online Store; to publish or withhold and/or delete User reviews; and to protect intellectual property rights.
15.2The Online Store is obliged to provide the Buyer with information regarding the Goods, to process exchanges and returns of Goods in accordance with the terms of the Agreement, to take all necessary actions for the delivery and payment of the Goods by the Buyer, to consider Users’ requests and complaints, and to store and not disclose Users’ Personal Data except in cases provided by law or specified in the Agreement.
16. User Consent
16.1The User agrees not to engage in any unlawful actions and not to use, directly or indirectly, fraudulent methods or system vulnerabilities aimed at interfering with the operation of the Online Store, including spamming, mass mailings, or flooding.
16.2The User agrees not to use automated software, emulators, bots, or any other unauthorized third-party software intended to modify or interfere with the Online Store’s software.
16.3The User agrees not to create multiple Personal Accounts under one identity and not to share access to the Personal Account with any third parties in order to preserve the confidentiality and rights of the User.
16.4The User agrees to promptly notify the Online Store if they lose access to their Personal Account due to unauthorized access by other individuals.
17. Claims
17.1In the event that the Buyer does not wish to receive information regarding offers/advertisements for Goods and/or information regarding promotions and discounts from the Online Store, the Buyer has the right to contact the Online Store’s managers with a request to opt out of receiving advertising materials and/or to send such an opt-out request via email and/or through the Online Store’s messaging systems.
18. Protection of Personal Data
18.1By accepting this Agreement, the User consents to the collection and processing of their Personal Data for the purpose of receiving services from the Online Store. The list of Personal Data processed by the Online Store is defined by this Agreement, namely in the sections on registration and authorization, payment, and delivery.
18.2We strive to protect and maintain the confidentiality of the Personal Data provided by Users. To achieve this, we have implemented appropriate rules and technical measures to protect the data under our control from unauthorized access, misuse or disclosure, alteration, destruction, or loss, in accordance with the provisions of the Law of Ukraine "On Protection of Personal Data," which establishes the rules and conditions for the collection, storage, use, and protection of Personal Data of citizens in Ukraine.
18.3As long as you remain a User of the Online Store, you grant the Online Store the right to process, transmit, store, and create backup copies of your Personal Data for the purpose of providing the services under this Agreement, including receiving and processing order information and sending advertising and special offers via communication means for the commercial promotion of Goods by the Online Store.
18.4The Online Store guarantees that Users’ Personal Data will be maintained as confidential and will not be transmitted, disclosed, or made otherwise available to any third party, except to employees, Suppliers, or carriers who require access to and use of Users’ Personal Data for the purposes of this Agreement.
18.5The Online Store undertakes not to disclose any Personal Data received from the Buyer and to comply with the requirements of the Law of Ukraine "On Protection of Personal Data," except in cases where the Buyer’s Personal Data must be disclosed and transmitted to authorized state authorities in Ukraine in accordance with laws or any regulatory acts, and/or if the Personal Data is made public by the Buyer.
18.6You may review the Online Store’s Privacy Policy by clicking on the internal link. The Privacy Policy applies to Users during the processing of Personal Data for marketing, analytical, and statistical purposes, as well as for improving the functionality of the Online Store.
19. Use of Cookies
19.1We use cookies to enhance and simplify Users’ interaction with the website. Cookies are necessary to store the settings you have chosen in the Online Store (for example, language or to remember your preferences). We use cookies in accordance with GDPR requirements and the relevant guidelines and rules provided by the EDPB. We rely on the Users’ consent and the legitimate interests of the Online Store, as provided by Article 6 of the GDPR, when using cookies and similar technologies.
19.2For the operation of the Online Store, we use both essential and additional cookies. Essential cookies are always used and are necessary for the proper operation of the Online Store. Additional cookies are used only if the User consents to them. The User can decide to accept cookies completely or partially, or to block or delete cookies; however, if the essential cookies are not accepted, the User may experience limitations in the functionality of the Online Store’s website.
20. Intellectual Property
20.1All intellectual property rights, including copyrights, trademark rights, and any other proprietary rights with respect to the Content displayed on the website and on the Online Store’s social media, belong to the Online Store. Unless expressly stated otherwise, the User must assume that all Content and associated property rights are protected by intellectual property laws and may not be used in any manner other than as permitted by this Agreement.
20.2The User is not entitled to any of the Online Store’s Content and agrees not to copy, republish, modify, distribute, license, or create derivative works or ideas based on the Online Store’s Content and services, except as explicitly provided in this Agreement.
20.3The unauthorized use of the Online Store’s intellectual property is strictly prohibited. The Online Store will enforce its intellectual property rights in accordance with Ukrainian law. The use of any part of the Online Store’s Content by Users is governed by this Agreement.
21. Warranties
21.1The Online Store’s obligation to deliver an order is deemed fulfilled at the moment the Good is handed over to the delivery service. The Buyer assumes the risk of loss or damage to the Good after it has been transferred to the delivery service.
21.2With respect to the quality of its own Goods, the Online Store guarantees compliance with quality standards provided that the Buyer uses the Good in accordance with its intended purpose, usage conditions, and technical specifications. However, the Online Store is not responsible for the quality of the Good if the Buyer uses it contrary to its intended purpose or fails to follow the instructions and usage conditions provided on the Good’s label.
21.3In the event that the Good is delivered by “Nova Poshta”, the Online Store does not guarantee the quality and conditions of delivery. In this case, “Nova Poshta” is the guarantor of delivery. You can review the delivery service terms of “Nova Poshta” via the provided internal link.
21.4In the event that the Good is delivered by “UkrPoshta,” the Online Store does not guarantee the quality and conditions of delivery. In this case, “UkrPoshta” serves as the guarantor for delivery. The delivery service terms of “UkrPoshta” can be reviewed via the provided internal link.
21.5The Online Store does not provide any warranties regarding availability. We are not liable for any consequences arising if the Online Store becomes inaccessible to the User at any time. Furthermore, the Online Store cannot guarantee that it will always be free from destructive or defective elements. Users agree not to hold the Online Store responsible or attempt to hold it responsible for any technical issues, failures, or malfunctions of the website, communication network failures, software issues, access problems or bandwidth limitations, high internet traffic consumption, security breaches, unauthorized access, or any other similar issues and deficiencies, including any problems with accessing the Online Store.
22. Liability
22.1The Online Store is not liable for any changes in the external appearance, composition, or set of the Goods introduced by the Supplier, although it strives to update the information regarding such changes.
22.2The Online Store is not responsible for any deficiencies in the Good that may arise after its delivery to the Buyer. Such deficiencies may occur due to violation of the rules for using or storing the Good by the Buyer, actions by third parties, or unforeseen circumstances considered force majeure.
22.3The Online Store is not liable for the processing of Users’ Personal Data or for payments handled by the “LiqPay” payment system.
22.4The Online Store is not liable for the improper performance or non-performance of its obligations if the Buyer provides outdated or incorrect Personal Data when placing an order.
22.5The Online Store is not liable for any loss of full website functionality due to the absence of access to WiFi or mobile networks. When using the Online Store outside a WiFi zone, please be aware that your agreement with your mobile service provider applies, and during such use the mobile operator may charge you for the provided communication services. The Online Store does not guarantee that you can access its services at any time or in any location of your choice, nor that it will be able to provide services in every geographic area or to the full extent.
22.6The Online Store is not responsible for any errors or omissions in the Content and services, and any published information may be altered without prior notice to the User. The Online Store is not liable for any losses or damages incurred as a result of the User relying on the Content and services received through the website. The User is fully responsible for their actions based on the services provided.
22.7Please also note that we are not liable for cases where someone impersonates the Online Store’s representatives in an attempt to obtain any of your information. Please ensure that you communicate only with our official support channels as specified in the “Feedback” section of this Agreement.
23. Amendments to the Terms of the Agreement. Governing Law
23.1We reserve the right to review and modify the terms of this Agreement at any time. We do not send individual notifications of changes to each User; instead, such notifications are published on the Online Store’s pages. If the User continues to use the Online Store’s services after the changes have been published, they consent to and accept the modifications to the Agreement.
23.2The provision of services by the Online Store—including the procedures for purchase, payment, delivery, return, and exchange of Goods, as well as the processing of Users’ Personal Data—is governed by Ukrainian law.
23.3All disputes arising under and/or related to this Agreement shall be resolved through negotiations between the Parties. If the dispute cannot be resolved through negotiations, it shall be settled in court in accordance with the current legislation of Ukraine.
24. User Reviews
24.1Users may leave reviews and recommendations regarding the Goods and services of the Online Store. Before publishing any reviews, please ensure that they are not unlawful, harmful, threatening, defamatory, or offensive to the dignity of another person, nor do they infringe intellectual property rights or contain information that promotes hatred and/or discrimination against people based on race, ethnicity, gender, religion, or social status. Reviews containing insults directed at specific persons or organizations, as well as any other content that violates current Ukrainian legislation, may be removed.
24.2Users bear personal responsibility for their reviews and agree that any public publications on the Online Store may be removed without the Users’ consent. The Online Store is not liable for any information posted by its Users and may choose not to publish reviews or provide links to them.
24.3We collect reviews and recommendations regarding the Goods and services of the Online Store for the purpose of advertising and marketing promotion, as well as to respond to your inquiries and improve our services.
